Auction Terms & Conditions Terms: 1. All items sold 'AS IS, WHERE IS' with all faults and the buyer assumes all liability for any item purchased. 2. All item descriptions believed accurate but not warranted by the University of Louisville or McGinnis Auction & Appraisal Service. Any weights or measurements when specified in the descriptions are approximate and may not be actual and should be physically verified by the bidder. Any equipment deficiencies noted may be posted in the item descriptions, and it should be noted this is used equipment with blemishes, dents, scratches or other defects. 3. Bidder inspection is highly encouraged. Please attend the open house & preview period prior to bidding; once you have been notified as the winning bidder on an item, it is your item and your responsibility to make full payment under the terms of the auction; Visa & MasterCard only. 4. By placing a bid, bidder signifies that they have examined the item(s) to their satisfaction, or that they have chosen not to personally examine them. 5. The University of Louisville or McGinnis Auction & Appraisal Service reserve the right to reject any bid. 6. Applicable sales tax for Kentucky is 6% all sales tax exemption certificates must be on file before the bidding begins or taxes will be charged. Ky Exemption forms must be emailed to johns.mcginnis@hotmail.com (subject: Tax Certificate) 7. Full payment is expected at the conclusion of the auction and Visa or MasterCard, are the only charge cards accepted for this auction, and the only forms of acceptable payment; no cash or checks will be accepted for this auction. A 7% Buyer's premium will be added to the high bid to determine the final purchase price. Any bidder who fails to make full payment as specified will be barred from all future auctions conducted by by the University or McGinnis Auction & Appraisal Service. 8. The auction company reserves the right to use any credit card on file to complete the purchase transaction once the auction closes. 9. Scheduled pickups will be only at the specified dates & times, on Friday, August 12 and between the hours of 8:00 - 4:00 or as agreed with the university staff. Purchase pickups will be made at the Central Receiving Warehouse, 1900 Arthur Street. All inquiries regarding purchase item pickup should be directed to Ms. Susan Carmack, 502-852-2986. No other pickup times have been specified for this equipment. Any items not picked up or as arranged will be considered abandoned and the University reserves the right to resell at a future auction. 10. A forklift & operator will be provided at load out but no Packaging Material or Shipping Services will be provided by the University or the Auction Company. All packaging material or shipping will be the responsibility of the buyer. Arrangements can be made through shipping providers such as Nick of Time Freight Brokers, Leon Duke, President, Toll Free 888-247-9393, ext. 1. or other shipping services such as Uship, again no assistance will be provided by the University or the auction company for packaging or shipping arrangements. 11. All payments must be by the credit card used during bidder registration, no cash or check payments will be accepted for this auction. 12. The University Staff and the Auction Company reserve the right to bid on any item scheduled in this auction. 13. This is an internet-only auction, there will be no live bidding for these items. 14. Neither the University or the auction company will accept any liability regarding any item purchased or attest to the usefulness of these items. 15. Items will be removed from Crawford Gym by the University staff and equipment will be moved to 1900 Arthur Street, Central Receiving Warehouse. Pickup will be on August 12, 8 - 4 PM, The University point of contact for pickup will be Ms. Susan Carmack, 502-852-2986. Please call to verify that your purchases have reached the warehouse prior to going to the warehouse. All pickup arrangements must be made with the University staff and not the auction company.
