Auction Terms & Conditions TERMS & CONDITIONS Internet Auction - This is an Internet only auction, registration requires a valid Visa, MasterCard, Discover or American Express. Bids will only be taken via the Hibid online portal. If shipping via a third party company, you will have to wire funds to McGinnis Auctions before shipped. Call for instructions. 812-282-7253. A pre-authorization will be performed to determine credit availability prior to your bidding. Debit cards may show a hold on funds for a short period, nothing will be charged to your credit card until a purchase has been made. Bidders will have set maximum bid amount limits per lot until approved by the auctioneer. Not internet savvy? - Absentee bids are not normally accepted for these online auctions but absentee bids may be handled on a case by case basis. All bidding is encouraged to be handled through the online bidding services provider Hibid. Bidding - By placing a bid, the bidder signifies that they have examined the items to their satisfaction, or that they have chosen not to personally examine them. At our sole discretion McGinnis Auction & Appraisal Services reserves the right to reject any bid during this auction.*** This auction is using the flat bidding style. (Not max bid! What you bid is what will reflect) Bids are Binding - The sale of all property will be at absolute auction and all items are sold as-is. A bid is a binding contract to purchase. Auction Staff Bidding - Auction Company employees & family of the seller reserve the right to place a bid on any item scheduled for this auction but must adhere to all terms & conditions set for the general public. Ownership must transfer and payment must be made. Item Condition - All items are sold "AS IS, WHERE IS" with all faults. No warranty, refunds or exchanges, All SALES ARE FINAL. No credit card charge backs will be allowed. It is incumbent upon the bidder to inspect the items during the preview period. We disclose what we know. Buyer’s Premium - (10% or 12%) Card payments will have a 12% Buyer's Premium collected on each item purchased during this on-line auction to determine your final contract purchase price. Paying Cash will reduce the buyer's premium to 10% / please notify us if you are paying cash prior to the end of the sale. Closing - Auction completion / soft close - Janurary 27th, 2023 @ 4:00 P.M. Technical Issues - McGinnis Auction & Appraisal Services reserve the right to pausw, cancel and/or reopen the auction in the case of system failures and McGinnis Auction & Appraisal Services can not accept or will not accept any responsibility for any technical failures during this auction. Payment - Final payment due at auction closing on all purchases. The credit card used at registration will be processed at the end of the sale. There will be no personal checks accepted for this auction. You may pay CASH or use another card at pick-up if you send the auctioneer a note prior to the end of the sale. If having items shipped via a third party shipper the Auction Company may require another payment method such as wire transfer prior to items being shipped. Non Payment - Bidders who fail to make full payment after being notified they are the winning bidder will be reported to HiBid and will no longer be allowed to bid at any of our future live or online auctions. Pick Up Location - 417 Spring St, Jeffersonville, IN 47130 LOCAL PICKUP ONLY - You must arrange any shipping / shipper if needed. Shipping - We do not offer shipping! Buyers must make their own arrangements for shipping if needed at their own risk and expense (3rd party). This means that the company or person you hire to pick up must be onsite to retrieve your items during the allotted pick times. No exceptions. An option for shipping service - Fragile Pack - 502-423-0000. If having items shipped via a third party shipper the Auction Company may require another payment method such as wire transfer prior to items being shipped. Loading / Pickup - Buyers are to bring boxes, packing materials and all manpower as needed to disassemble and load purchased items. If tools are needed for disassembly or removal the buyer will need their own tools, including dolly or other equipment required to remove & transport items from the auction site. The auction company cannot assist in loading of purchased items. NO auction staff can move items for you. Failure to Pickup - All items of personal property must be paid for and removed from the auction site by the end of the pickup schedule. Bidders failing to pick up items by the times specified agree they will be charged the full purchase amount plus all premiums on the credit card on file and used during the bidder registration. All actions requiring the collection of insufficient funds will be handled by whatever legal means available in the State of Indiana. If you do not pick up your items, they are considered to be abandoned. The auction company can dispose as they see fit of any and all items, Disputes & Collections - Any disputes or collections will be filed or settled in the Courts of Clark County, Indiana.
